Many times as an experienced Rochester Family Law Attorney, I am asked how spousal support is calculated or formulated in New York. New York State now has a formula in order to determine how much spousal support, if any, someone would have to pay. This is going to depend on your income and your spouse’s income. Generally, if there’s a great difference between the incomes, you could expect that you’re going to have to either pay some amount of support or that you would get it. If you’re incomes are relatively close, then you’re likely not going to receive or pay spousal support. As a Rochester Family Law Attorney, I tell my clients that the factor a court will look at is if it was a short term marriage, then there may not be a need for spousal support.
