Many people ask me as a Rochester Divorce Lawyer, whether or not they should stay in the same house while the divorce is pending. Typically that depends upon you. If you’re comfortable being in the house, if you and your spouse get along well enough, and you can handle it, stay in the house as long as you can. Sometimes people aren’t able to stay in the house because there’s a lot of animosity and there are a lot of hard feelings between the parties. In that case, it’s okay to leave. I advise my clients as a Rochester Divorce Lawyer, that you’re allowed to leave and you won’t give up any rights or lose anything you have in the divorce because you left the house.
