As an experienced Rochester Divorce Attorney I regularly get questions from individuals who are wondering if they are entitled to their spouse’s retirement plan. Sometimes the biggest asset that needs to be divided in a divorce are retirement accounts. Retirement accounts that accumulated during the course of the marriage are marital property. Sometimes your spouse might have worked at an employer prior to the marriage, during the marriage, and then after the marriage. We take out that portion of the retirement account that accumulated during the course of the marriage and you’re each entitled to an equitable share. Sometimes you have roughly the same amount of retirement assets as your spouse and you choose not to take anything. Sometimes one spouse has considerably more assets than the other and then what we would do would be a Qualified Domestic Relations order and divide that asset.
